The ruling by the New York State Supreme Court’s appellate division signals a possible end to a legal battle over the terms of the race, and paves the way for Valencia in Spain to host the 33rd America’s Cup next year.
Alinghi’s sponsoring club, the Société Nautique de Genève (SNG) said in a statement after Tuesday’s ruling that it looked forward to racing in Valencia in February. A spokesman for challenger Oracle’s sponsoring club, the Golden Gate Yacht Club, said the new ruling was “a big stride forward”.
The Swiss syndicate originally chose Ras al-Khaimah in the UAE as the venue but this was rejected by a New York Supreme Court judge on October 27 because it is in the northern hemisphere. The Cup’s rules state racing cannot take place in the north between November 1 and May 1.
Alinghi offered Valencia as a substitute but then did an about-turn, settling on the UAE again. The appeals court on Tuesday reinstated the Supreme Court ruling.
Valencia has been deemed acceptable because it was the site of the previous race in 2007.
